Resumo

O artigo apresenta uma análise histórica da forma na que os crimes contra a humanidadese convertem em delitos autônomos dos crimes de guerra e de agressão desdeo momento em que este concepto se introduz nas discussões que tiveram os Aliadosquando estava se criando o Tribunal Militar Internacional de Nuremberg. O textodescreve a maneira como este concepto tem se desenvolvido e discutido em diversasinstâncias internacionais até chegar ao Estatuto de Roma da Corte Penal Internacional.Neste artigo se mostra como os Juízos de Nuremberg têm um significado jurídicoe histórico transcendental posto que, conseguem institucionalizar a responsabilidadeindividual ante um tribunal internacional para uma nova categoria de crimes.Igualmente, mostra como após dos Juízos de Nuremberg, os crimes contra a humanidadeforam gradualmente retirados do âmbito da soberania estatal e passaram aser um assunto da comunidade internacional das nações.
