The following article demonstrates how the Public Action of Unconstitutionality (Acción Pública de Inconstitucionalidad) developed under the Colombian Radical Liberal’s rule during the XIX century. An 1879 law pronounced by the sovereign Cundinamarca State, in which the autonomy of the Colegio Mayor del Rosario was annulled, is also studied in depth in this article. The aforementioned law was legally challenged by two ex-presidents of the Colegio Mayor del Rosario, then studied by the Supreme Court and finally annulled by the Senate of the United States of Colombia.
