Abstract

The article concerns the concept of legal security and its relation to precautionary measures being introduced in relation to judicial preventive tutelages in contentious administrative proceedings. It will demonstrate their inadequacy as a mechanism to protect the rights of claimants and will propose a solution that considers current contributions from comparative law.
