Abstract

The reappearance of the adhesion contracts is explained by economic reasons linked to the commerce massive extension. The main problem of the standard contracting been the existence of abusive clauses, it is required an analysis of the control system foreseen in the national legislation. This appears to be incompetent to avoid the presence of abusive clauses in contracts at general  conditions.Thus the need to contemplate a preventive mechanism that, added to repressive control, allows an efficient protection not only for  consumers but for all individual that could be exposed to a contract with abusive contents.
