Abstract

Through an explanation of some of national and international tools as well with a short history, this article exposes the legal aspects of the declaration of a good as part of the national cultural inheritance. Legal doctrine and some court opinions are taken into account for making this kind of declaration. As a conclusion, this article exposes a theory about cultural inheritance. This entitles elements such as competent institution, categories, private properties effects and participative rights. Finally, the issue is explained with some cases related to the protection of humid soil.
