A pesar de que los estudios sobre género y sexualidad vienen realizándose desde la década de los ochenta, solamente en décadas recientes se han publicado escritos relacionados con la lectura de la teoría LGBT sobre el Derecho Internacional. Mediante un análisis desde esta teoría es posible develar los silencios que posee el Estatuto de Roma de la Corte Penal Internacional respecto a la posible investigación y eventual sanción de crímenes internacionales o graves violaciones a Derechos Humanos cometidas en contra de miembros de este sector de la sociedad. Así pues, en primer lugar, se analizan el preámbulo, el crimen de genocidio y los crímenes de lesa humanidad, entre otras disposiciones del Estatuto, con el fin de mostrar los vacíos que posee
este marco regulatorio para proteger a la población LGBT. En segundo lugar, con el fin de explicar los vacíos normativos, se utilizarán criterios de análisis de la teoría LGBT a partir de los cuáles se puede develar cómo los actores que intervinieron en la creación y aplicación del Estatuto de Roma entienden qué es la sexualidad y quiénes son los LGBT, para así comprender el por qué de la configuración actual de las normas de Derecho Penal Internacional. Finalmente, se concluye sobre cómo con una lectura conjunta entre las perspectivas clásicas y críticas sobre el derecho internacional es posible tener un mejor entendimiento de la posición que tienen los LGBT en esta rama del derecho internacional público.
