Resumo

Em um artigo fundador que apareceu em 1991 intitulado «Feminist Approaches to International Law», Hillary Charlesworth, Christine Chinkin e Shelley Wright, denunciam o Direito Internacional como um «thoroughly gendered system». Estas autoras estimam, em efeito, que a dominação masculina se pode identificar tanto no conteúdo quanto na estrutura de toda uma série de regras do Direito Internacional. O presente artigo busca estabelecer uma avaliação desta hipótese com relação aos discursos e às regras do direito da paz e da segurança internacional. Na análise, e especialmente com relação à resolução 1325 de 2000 e o que tem sucedido com posterioridade com as teorias feministas, aparecem estas como um motor de mudança na retórica, mas também no longo prazo, na prática. Em contraposição, estas teorias mostram certos limites quando pretendem denunciar, para além da violação dos direitos individuais da mulher, a «masculinidade» das regras que constituem o Jus contra Bellum.
