This article seeks to identify types of situations in which judicial power has taken on the task of verifying legal standards in the design and development of public policies in regard to the guarantee of social, economic and cultural rights as well as civil and political rights. Based on the study of national and international precedents, this paper establishes four types of judicial decisions in this matter. Finally, it analyses judicial interventions which seek to guarantee to social organizations and movements the right to participate in the design of those policies.
