This paper, follows the debate that has taken place in Colombia on national security, on the one hand, and individual rights and guaranties. It discusses the policy of national security withhold by the government, the legal changes than such policy has produced and the creation the new juridical forms, that seek to neutralize the liberal spirit of the l991 Constitution. It underscores the constitutional definition of social state of law, and the pronouncements of the Constitutional Court on the subject, and ends whit a reflection and the role that law can play in it.
