The doctrine and the jurisprudence of many countries have evolved with time in search of new elements that allow a better protection on the patient’s interest, which has gained importance against the desprotection of which it was victim, being considered the weak side in the Physician-Patient relation. This evolution, result of arduous work that struggles for a more human conception of the jurisprudence, has not been an exception in Italy, country that progresses towards a construction of a medical liability model, applicable not only to the physician in particular, but to the hospitable structure, suggesting also new figures and mechanisms that will allow an effective and real protection of the patients.
