This article seeks to address gender equity by opening a discussion on menstrual rights, emphasizing the legal recognition of menstrual rights as fundamental rights. Through qualitative methodology, a systematic review of regulations, national and international jurisprudence, NGO reports and doctrine was carried out in order to delve into the causes that allow the detriment in different aspects of the lives of menstruating people. Once the proposed analysis was carried out, it was concluded that menstrual rights are categorized as fundamental due to their intrinsic connection to the exercise of human dignity, life and personal integrity of those who menstruate, since it is a natural process.
