This article makes study of the historic evolution of the concept of the historic bays and waters. Then it makes an analysis of the concept as an exception of the article 10 of the 1982 United Nations Convention on the Law of the Sea. The article also determines the necessary conditions for the existence of this kind of bays; for this purpose it describes different concepts like international custom, historic titles, effective possession, acquiescence, the time factor and prescription on public international law.
