La necesidad de complementar la definición de acto de agresión, ¿forzados a una definición insuficiente ante ciberataques en la guerra moderna?

This article examines how the definition of “act of aggression” established in un General Assembly Resolution 3314 of 1974 is insufficient in the face of new forms of interstate violence driven by digital technologies. It starts with the idea that certain cyberattacks should be considered acts of aggression under international law, as they directly impact critical infrastructure and the sovereignty of States. The analysis combines dogmatic, normative, and doctrinal approaches to propose a hypothetical provision as an amendment to the definition of aggression contained in article 3 of Resolution. In addition, it discusses the theoretical challenges related to state attribution and the way in which damage materializes in the cyber realm.
