This paper deals with the role of custom as a basis for criminal liability in the Statute of the International Criminal Court (ECPI). First, it studies its place in the system of sources of the Statute. Then specifically investigates whether there is a ban on the ECPI substantiate criminal liability under customary law. To do this, he studies the scope of the principle of legality in the system of the ICC and its relation to customary law. It then analyzes whether the ECPI supports the use of customary law as a criterion of interpretation, even to the detriment of the accused. Finally, it deals with the proposal to base criminal liability directly on customary rules when the ICC has jurisdiction over crimes committed on the territory and nationals of non-party States. The paper concludes that although the ECPI recognizes custom a marginal role that it had in previous experiences of international criminal law, there are, however, areas in which this source can have meaning and that even in relation to the merits of criminal liability.
