El cambio climático es uno de los temas dominantes de nuestro tiempo, pero los esfuerzos nacionales e internacionales no corresponden a sus expectativas. Por ello, se depositan grandes esperanzas en la criminalización del ecocidio.


Este ensayo analiza si puede cumplir estas expectativas. Para ello, discute la compatibilidad del Derecho Internacional Penal y Ambiental y las posibilidades del Derecho Penal para proteger el clima mediante la disuasión y la expresividad. Se plantea, entonces, la cuestión de si debe adoptarse un enfoque antropocéntrico o ecocéntrico para el ecocidio. En particular, se contempla la compatibilidad de la protección del medio ambiente con los intereses humanos legítimos y nuestra limitación a las perspectivas humanas. Por último, se cuestiona que la Corte Penal Internacional sea el foro adecuado para la criminalización del ecocidio. Aquí, se debate la responsabilidad penal individual y la aplicación selectiva de la Corte Penal Internacional.
