This article seeks to evaluate the interpretation carried out by the Dispute Settlement Body (DSB) of the wto about the concept of “like products” under article 2.1 of the Agreement on Technical Barriers to Trade (TBT) in recent cases (United States-Clove cigarettes, United StatesTuna II and United States-COOL), with the end of suggesting certain interpretative elements in accordance with the Vienna Convention on the Law of Treaties which could have influenced a different interpretation of “like products”by the DSB.
