En el derecho internacional, la guerra y el genocidio se consideran “flagelos odiosos para la humanidad”. Los actos sistemáticos de violencia estatal durante la guerra pueden fácilmente derivar en la comisión de genocidio. Si los Estados utilizan la violencia en defensa propia, la guerra puede proporcionar un alibi y ocultar la comisión de genocidio. Al mismo tiempo, el genocidio durante la guerra puede confundirse fácilmente con un simple efecto colateral de la guerra y/o con crímenes de guerra menos graves. En consecuencia, la determinación de la responsabilidad internacional de los Estados por genocidio es más difícil en tiempos de conflictos armados, ya sean internacionales o no internacionales, que en tiempos de paz. La invocación de la responsabilidad de Rusia, Ucrania e Israel por la comisión del “crimen de todos los crímenes” durante la guerra en Ucrania y la guerra en Gaza ilustra estas dificultades y revela el impacto limitado de las sentencias de la “Corte Mundial" en la prevención tanto de la guerra como del genocidio.
